You agree not to: use the Platform for any unlawful or unauthorized purpose; interfere with or disrupt the integrity or performance of the Platform; copy, distribute, modify, or create derivative works based on the Platform; attempt to gain unauthorized access to the Platform or related systems.

5.Data Ownership and Privacy

You retain ownership of any data or content you upload or transmit through the Platform ("User Data"). By using the Platform, you grant True Horizon a non-exclusive, limited license to use, process, and display your User Data as necessary to provide the services. True Horizonrespects your privacy. 6.Confidentiality

Both parties agree to maintain the confidentiality of non-public, proprietary information disclosed during the course of using the Platform. Confidential information will not be disclosed to any third party without written consent, except as required by law.

All content, software, and technology provided through the Platform are the property of True Horizonor its licensors and are protected by intellectual property laws. No rights or licenses are granted except as expressly set forth in these Terms.

8.Availability and Modifications

True Horizon may modify or discontinue any part of the Platform at any time without prior notice. While we strive to ensure uninterrupted access, we do not guarantee continuous availability of the Platform.

9.Disclaimers

True Horizon makes no warranties or representations of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the accuracy or completeness of any information made available through the Platform.

10.Limitation of Liability

To the maximum extent permitted by law, True Horizon shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits or data, arising from your use of the Platform. Truehold’s total liability for any claim related to your use of the Platform shall not exceed the amount paid by you (if any) in the 12 months preceding the claim.

11.Indemnification

You agree to indemnify, defend, and hold harmless True Horizon and its affiliates, officers, employees, and agents from and against any claims, losses, liabilities, damages, or expenses arising from your use of the Platform or your violation of these Terms.

12.Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be resolved in the courts located in Albuquerque, New Mexico.
